Initiative to expand oversight powers in environmental matters

On February 1, 2024, the Environmental Commission of the Congress of the State of Nuevo León approved the “ Initiative with draft decree that modifies section VIII of article 1 of the Environmental Law of the State of Nuevo León” , proposal by the Constitutional Governor of the Free and Sovereign State of Nuevo León.

Through this initiative, it is proposed to eliminate what is established in the Environmental Law of the State of Nuevo León in that the powers of the authorities of the State of Nuevo León, to monitor, supervise and sanction those sources of pollutants are not applicable in the case of matters that are considered to be of exclusive federal authority.

According to the explanatory statement, the proposed reform is due to the fact that the current regulations found in the Environmental Law of the State of Nuevo León limit attendance and state authorities from being able to intervene in cases that are established under federal jurisdiction, therefore that the modification of the aforementioned article has been justified under the premise that greater powers should be given to the state authorities, derived from the need and obligation to monitor and ensure the protection of the healthy environment of the entire territorial district of the State.
