一、ゼロ・コロナ政策の解除と日中間往来の正常化 2022年12月、中国政府は、2020年初頭から3年弱の間続いたゼロ・コロナ政策を、事実上撤廃しました。同政策は、中国で事業を展開する多国籍企業にとって、グループ内の事業活動、特に人的交流への大きな制約として働いた面がありました。そして、日本企業でも、その中国事業を担う現地のスタッフ及び駐在員等の日常生活及び業務に対して大きな影響がありました。 同政策の撤廃に伴い、ほぼ3年の間、事実上制限されてきた日中間の往来が正常化していくことが期待されます。多国籍企業でも、中国と外国の間の各種交流を徐々に再開させているとの報道もあります。 ゼロ・コロナ政策が中国内で事業を展開する多国籍企業に与えた影響の一つに、コンプライアンス・内部管理のための各種施策への影響もあったとされています。例えば、本社側の監査人における往査等は、中国での厳しい隔離措置などの影響で事実上中断されてきました。さらに、中国での生活環境への大きな制約等から、西側諸国の親会社が求めるコンプライアンス実務を理解した人材の中国への派遣や採用が難しくなり、中国現地事業のコンプライアンス管理の維持に向けたリソースの確保 に苦労した企業もあったようです。 中国で事業を展開する日系企業は、3年間続いたゼロ・コロナ政策の中で比較的大きな制約を受けた分野などを手始めに、その手当を行うことを予定されていると思います。本稿では、グループ管理体制のレビューなどに向けた取組の参考とすべく、近年の日系企業の中国事業に関連して開示された不正調査の報告書を題材として課題の検討を行います。 続きはこちらからどうぞ・Please click here to read more.

一、大手外国製薬会社のオフサイト検査不合格 1. １　はじめに 破産手続の開始後も，破産者が自由財産から保険料支払を継続し，契約更新を行ったとしても，その後に発生した共済事故に係る共済金請求権は破産財団に帰属する（破産者には帰属しない）と判断した東京高等裁判所の判決を紹介します。 ２ 事案概要 破産者は，破産手続開始決定前に自己所有建物等を目的とする火災共済契約（「本件共済契約」）を締結し，破産手続開始後も共済掛金の支払を継続し，本件共済契約は自動更新されていました。破産手続開始決定・自動更新後，保険事故（「本件火災」）が発生しました。共済連合会は，債権者不確知を供託原因として，本件火災に係る共済金を供託しました（「本件供託」）。破産管財人は，本件火災に係る共済金請求権（「本件共済金請求権」）が破産財団に帰属するとして，本件供託に係る供託金請求権を破産管財人が有することの確認を求めました。他方，破産者は，本件共済金請求権は破産者の新得財産であるとして，共済連合会に対し共済金の支払を求めました。時系列は以下のとおりです。… 続きはこちらからどうぞ・Please click here to read more.

本件の仮処分命令申立事件は、ある美術館（本件美術館）及びその庭園（本件庭園）の設計者とされる債権者（X）が、本件美術館及び本件庭園の改築工事（本件工事）の実施を計画している地方公共団体である債務者（Y）に対して、Xの著作者人格権（同一性保持権1）が侵害されるおそれがあると主張して、著作権法112条1項に基づき、本件工事の差止めを求めた事案です。 まず、東京地裁は、本件美術館等の著作物性の判断について、「美術」の「範囲に属するもの」に該当するか否かを判断するためには、建築物としての実用目的を達成するために必要な機能に係る構成と分離して、美術鑑賞の対象となり得る美的特性を備えた部分を把握できるか否かという基準によるのが相当であるとしました。加えて、「著作物」は、「思想又は感情を創作的に表現したもの」でなければならないから、建築物が「建築の著作物」 として保護されるためには、同要件を充たすか否かの検討も必要となり、その要件のうち、創作性については、著作権法の目的に照らし、建築物に化体した表現が、選択の幅がある中から選ばれたものであって保護の必要性を有するものであるか、ありふれたものであるため後進の創作者の自由な表現の妨げとなるかなどの観点から、判断されるべきであるとしました。 その上で、東京地裁は、本件美術館の有する次の構造について評価し、建物としての実用目的を達成するために必要な機能に係る構成とは分離して、美術鑑賞の対象となり得る美的特性を備えている部分を把握することができ、全体として、「美術」の「範囲に属するもの」と認められ、かつ、これらの構造の中には、設計者が選択の幅がある中からあえて選んだ表現が認められるとしています。 Please click here to read more.  

1.　事案の概要 本件は、名称を「多角形断面線材用ダイス」とする発明（本件発明）に係る特許（特許第6031654号）の無効審判請求を不成立とした審決の取消訴訟です。本件訴訟の原告Xは無効審判の請求人、被告Yは特許権者です。 Xは訂正後の本件各発明（請求項1乃至12）について特許無効審判の請求をし、特許庁は同審判請求が成立しないとの審決（本件審決）をしたのに対し、本判決は本件各発明の「略多角形」の意義が不明確であり、明確性要件を充足するとした本件審決の判断には誤りがあるとして本件審決を取り消しました。本件発明1（請求項1）の特許請求の範囲の記載は以下のとおりです。 「略円筒形形状をもつ引抜加工用ダイスを保持し前記引抜加工用ダイスの前記略円筒形形状の中心軸を中心として前記引抜加工用ダイスを回転させるダイスホルダーと、内部に収納された潤滑剤が材料線材に塗布された後前記 引抜加工用ダイスに前記材料線材が引き込まれるボックスと、を含む引抜加工機であって、前記引抜加工用ダイスのベアリング部の開口部は略多角形の断面形状を有することを特徴とする引抜加工機。」 Please click here to read more.

Ⅰ　事案の概要 本件は、発明の名称を「エルデカルシトールを含有する前腕部骨折抑制剤」とする発明に係る特許権（「本件特許権」）を有するＸ（原告・控訴人）が、Ｙ１・Ｙ２（被告・被控訴人）が骨粗鬆症治療薬（「Ｙ医薬品」）を製造、販売する行為が本件特許権の侵害にあたると主張して、Ｙらに対し、特許法１００条１項・２項に基づき、Ｙ医薬品の生産等の差止め及び廃棄を求める事案で す。 原審は、①訂正前の請求項１、２及び４に係る各発明（「本件発明」）はいずれも乙１の文献（「乙１文献」）に記載された発明（「乙１発明」）に照らして新規性を欠くものであり（特許法２９条 １項）、②請求項４の訂正によっても無効理由は解消されないとして、Ｘの請求をいずれも棄却したため、Ｘは、これを不服として控訴を提起しました。 本判決は、①及び②のいずれについても原判決の判断を維持しました。本稿では、①に関する判断部分をご紹介します。 Please click here to read more.

１．はじめに 令和5年1月17日、メタバースなどの仮想空間での模倣品の規制のため、政府が同年の通常国会に不正競争防止法などの改正案（「本改正案」）を提出することが報じられました。本改正案に関わる論点は多岐にわたりますが、本稿では、不正競争防止法（「法」）2条1項3号（形態模倣行為）に関するこれまでの議論の状況をご紹介します。 2．不正競争防止法の定めと課題 法2条1項3号は、「他人の商品の形態（当該商品の機能を確保するために不可欠な形態を除く。）を模倣した商品を譲渡し、貸し渡し、譲渡若しくは貸渡しのために展示し、輸出し、又は輸入する行為」（「形態模倣行為」）を「不正競争」として定義しています。同号は、平成5年の法改正で追加された規定であり、例えば、ファッション業界におけるファッションデザインの保護においては、意匠法や著作権法による保護が難しい事例が多いため、同号による保護が機能する場面が多いとされています。 そこで、メタバースなどの仮想空間の活用が進んでいる現代においては、リアル／デジタルの交錯領域におけるファッションデザイン等の保護（例えば、有体物の商品が無体物としてコピーされる事例又はその逆の事例）についても、法2条1項3号を活用しようとする場面が生じ得るところ、そのような場面を想定したときの課題として、次の点が指摘されていました（令和4年2月28日開催 産業構造審議会 知的財産分科会 不正競争防止小委員会（「小委員会」）。 ①　同号の「商品」に「無体物」は含まれるか ②　同号はリアル／デジタルを交錯する模倣事例に対応できる規律となっているか Please click here to read more.

1．海外事業者から個人への模倣品流入の増加 最近ではインターネットを通じて海外事業者から個人が直接商品を購入することが増えています。これに伴い、個人が模倣品をインターネットを通じて輸入することも増えてきています。税関が把握する知的財産権侵害貨物は、2019年（令和元年）には2004年（平成16年）と比較して、差止件数が大きく増加している（約1万件から約2、3万件）のに、差止点数が同程度（約100万点）であることから、顕著に小口化しており、これは個人輸入が増えているからだとみられます。そして、差し止められる物件の95％を超える大多数は商標権侵害を理由とするものです。 従前の商標法では、標章を付した商品を輸入することは標章の使用にあたる（商標法2条3é …2号）ものの、業としての使用でなければ商標権侵害とはならない（同法2条1é …1号、25条）ため、模倣品の個人使用目的の輸入については商標権侵害にはなりませんでした。税関では、知的財産権侵害物品は「輸入してはならない貨物」として没収等の対象となる（関税法69条の11、1é …9号及び2項）ため、知的財産権侵害物品であるかどうかを認定手続により認定しています（同法69条の12）。その手続では、税関が知的財産権侵害物品の疑いのある貨物を見つけた場合には、権利者と輸入者に手続開始の通知がなされます。通知を受けた輸入者が、個人使用を主張して知的財産権侵害物品であることを争う場合には、輸入が許可されることになりますが、争わない場合には、没収等がなされます。従前は模倣品の輸入について争う輸入者は大変少なかったのですが（2008年（平成20年）には500件程度）、2018年（平成30年）には、6000件に迫る輸入者が争い、その理由の大半は商標権侵害物品に ついて個人使用目的であるとするものであり、結果、輸入が許可されています。また、諸外国をみても、アメリカでは古くから個人使用目的での模倣品についても商標権侵害物品、特許権侵害物品などとされ、共に輸入することができず、EUでは、従前輸入が認められてきましたが、2014年（平成26年）の欧州連合司法裁判所判決２によって、アメリカと同様の規制となりました。このような状況で、2020年（令和2年）には、多くの模倣品が個人へと流入することに歯止めをかけなければならないということがコンセンサスとなり、その方策が検討されてきました。 Please click here to read more.

Ⅰ　はじめに 本件は、「軟骨下関節表面支持体を備えた骨折固定システ ム」に係る発明について特許権（「本件特許¹」）を有する原告X が、被告Yによる橈骨遠位端用固定プレート（「Y製品」）等の販 売等が本件特許を侵害すると主張して、Yに対し、Y製品の販売 等について差止等請求を行った事件です（結論として、裁判所 は、Xの請求を全て棄却しました）。争点は多岐に亘りますが、 本稿では、均等侵害成否²の判断部分を紹介します。 Ⅱ　本件発明³の構成要件⁴・Y製品の構成 本件発明は、手掌手首骨折の固定のための固定プレートに 係る発明です。 本件発明の構成要件１Ｊは、固定プレートの頭部に備えられ た「第１の組の孔」及び「第２の組の孔」⁵について、「前記第１の 組の孔の前記軸線は、前記第２の組の孔の遠位側に突出し、前 記プレートが遠位橈骨に連結されると、前記第１の組の孔の前 記軸線が前記第２の組の孔の前記軸線間を通って、前記遠位 橈骨内に延びるように構成され」る構成を規定しています。 これに対し、Y製品では、孔の軸線は１本に定まる構成が採 用されていました。そのため、「第１の組の孔」の軸線は、遠位橈 骨内で「第２の組の孔」の軸線の間を通るように「第２の組の孔 の軸線」と交差することはなく、構成要件１Ｊを充足せず、文言侵 害は成立しません（この点については当事者間に争いはありま せん。）。 Read more

1　事案の概要 本判決は、乳がんの処置に使用されるエリブリンに係る後発 医薬品（「原告医薬品」）の製造を計画する者（「X」）が、先発医 薬品（「被告医薬品」）の発明（「本件発明」）に係る各特許権 （「本件特許権」）を有する者（「Y」）に対する本件特許権に基 づく差止請求権（予備的に将来の差止請求権）の不存在確認 の訴え、Y及び被告医薬品を製造する者（総称して「Yら」）に対 する本件特許権の侵害を理由とする損害賠償請求権（予備的 に将来の損害賠償請求権）の不存在確認の訴え、Yらに対する 原告医薬品が本件発明の技術的範囲に属しないことの確認 の訴えを提起した事案です。結論として、裁判所は、Xの訴えに つき、いずれについても確認の利益がないと判断し、訴え却下 判決を下しました。 以下では、紙幅の関係から、現在のYの本件特許権に基づく 差止請求権及び現在の本件特許権の侵害を理由とする損害 賠償請求権不存在確認の訴えについて、紹介いたします。 2　本件の経緯 Xは、令和3年5月7日頃、Yらに対し、2週間以内にYらにおい てXに対し、Xが承認の申請準備を進めている原告医薬品の製 造販売について本件特許権を行使しないことの確認をするよ う求める旨の通知をしました。これを受けてYは、令和3年5月 21日、Xに対し、YらはXによる原告医薬品の製造販売について 本件特許権を行使する可能性がある旨回答しました（「本件回 答」）。 その後、Xは、令和4年2月25日、厚生労働大臣に対し、被告 医薬品の後発医薬品として、原告医薬品の製造販売について の承認の申請をし、また、原告医薬品の製造販売を予定して開 発を進めており、製造販売についての承認の申請及びGMP適 合性検査の申請のための原告医薬品の製造を行っています Read more

国外のサーバから日本国内のユーザに向けてプログラムを配信する 行為について特許侵害を肯定した事例 1．事案の概要 本件は、いずれも名称を「表示装置、コメント表示方法、及び プログラム」とする特許第4734471号に係る特許（「本件特許 1」）及び特許第4695583号に係る特許（「本件特許2」）を有する 控訴人（「X」）が、被控訴人ら（「Yら」）が提供するコメント付き動 画共有サービスに用いられているプログラム（「Yらプログラム」） 等は本件特許1の請求項9及び10に係る各特許発明（「本件発 明1」）並びに本件特許2の請求項9ないし11に係る各特許発明 （「本件発明2」）の技術的範囲に属し、YらによるYらプログラム 等の生産、譲渡、貸渡し及び電気通信回線を通じた提供（「譲 渡等」）並びに譲渡等の申出は本件各特許を侵害すると主張 し、Yらに対して、①特許法100条1項に基づき、Yらプログラム等 の生産、譲渡等及び譲渡等の申出の差止め、②同条2項に基 づき、Yらプログラムの抹消、③民法709条及び同法719条に基 づき、損害賠償金の内金1億円及び遅延損害金の連帯支払を 求めた事案です。 本件発明1は、動画と共にコメントを表示する表示装置及び プログラムに関する発明であり、具体的な実施態様としては、動 画再生時間に応じてコメントを動画上に順次表示し、画面の右 側から左側に移動表示した後、動画の表示欄（第1の表示欄）と 一部のみが重なる別の表示欄（第2の表示欄）の内側であり、か つ、動画の表示欄（第1の表示欄）の外側に表示するようにする ことにより、コメントそのものが動画に含まれるものではなく、動 画に対しユーザが書き込んだものであることを把握可能にし、 コメントの読みにくさを低減させる効果を奏するというものでし た¹。

Japan January 8 2021 東京地裁（40部）令和2å¹´7月22日判決（平成31年（ワ）第1409号）裁判所ウェブサイト〔T-VEC事件〕 本件は、発明の名称を「ウイルスおよび治療法におけるそれ らの使用」とする発明（「本件発明」）の特許権者である原告X （大学教授）が、製薬会社である被告Yに対し、Yが本件発明の 技術的範囲に属するウイルスを使用して国内において行って いる治験（「本件治験」）はXの特許権を侵害すると主張して、同 ウイルスの使用の差止等を請求した事案です。本件発明にか かるウイルス（一般名タリモジェンラヘルパレプベク（T-VEC）） は、がんを治療する「腫瘍溶解性ウイルス」であり、昨今、国内外 の製薬会社が腫瘍溶解性ウイルスの激しい開発競争を繰り広 げています。 医薬品の製造販売承認申請のためには、臨床試験等の試験 を実施する必要がありますが、最高裁11å¹´4月16日第二小法 廷判決民集53å·»4号627頁(「平成11年最判」)は、後発医薬品 の薬事法14条（当時）の製造販売承認を申請するために、特許 発明の技術的範囲に属する医薬品を生産し、これを使用して 試験を行うことは、特許法69条1項にいう「試験又は研究のた めにする特許発明の実施」にあたり、特許権侵害とはならない と判示しました。 この平成11年最判の事案とは異なり、先発医薬品の臨床試験 である本件治験が特許法69条1項の「試験又は研究のためにす る特許発明の実施」に該当するかが争点となったのが本件です。 裁判所は、以下のとおり、本件治験が特許法69条1項の「試 験又は研究のためにする特許発明の実施」にあたるとし判示し て、Xの請求を棄却しました。 特許法69条1項の趣旨は、特許法1条に規定された「発明の 保護及び利用を図ることにより、発明を奨励し、もって産業の発達 に寄与する」ためには、当該発明をした特許権者の利益を保護 することが必要である一方、特許権の効力を試験又は研究のた めにする特許発明の実施にまで及ぼすと、かえって産業の発達 を損なう結果となることから、産業政策上の見地から、試験又は研 究のためにする特許発明の実施には特許権の効力が及ばない こととし、もって、特許権者と一般公共の利益との調和を図ったもの と解される。   本件治験が同項にいう「試験又は研究のためにする特許発明の実施」に当たるかどうかは、特許法1条の目的、同法69条1項の  立法趣旨、医薬品医療機器等法上の目的及び規律、本件治験の目的・内容、治験に係る医薬品等の性質、特許権の存続期間の延長制度との整合性なども考慮しつつ、保護すべき特許権者の利益と一般公共の利益との調整を図るという観点から決することが相当である。   本件治験の対象とされているT-VECは、外国の医薬品規制当局の製造承認を受け、我が国でブリッジング試験を行っている先発医薬品であるが、以下のとおり、本件治験についても、平成11  年最判の趣旨が妥当する。 â‘  平成11年最判は、後発医薬品が特許法69条1項にいう「試験又は研究のためにする特許発明の実施」に当たる理由として、後発医薬品についても、 他の医薬品と同様、その製造の承認を申請するためには、あらかじめ一定の期間をかけて所定の試験を行うことを要し、その試験のためには、特許権者の特許発明の技術的範囲に属する化学物質ないし医薬品を生産し、使用する必要がある点を指摘する。 ⇒先発医薬品等に当たるT-VECについても、後発医薬品と同様、その製造販売の承認を申請するためには、あらかじめ一定の期間をかけて所定の試験を行うことを要し、その試験のためには、本件発明の技術的範囲に 属する医薬品等を生産し、使用する必要があるということができる。 ②  平成11年最判は、特許権存続期間中に、特許発明の技術的範囲に属する 化学物質ないし医薬品の生産等を行えないとすると、特許権の存続期間が終了した後も、なお相当の期間、第三者が当該発明を自由に利用し得ない結果となるが この結果は、特許権の存続期間が終了した後は、何人でも自由にその発明を利用することができ、それによって社会一般が広く益されるようにするという特許制度の根幹に反するとしている。 ⇒T-VECについても、前記判示のとおり、その製造販売の承認 を申請するためには、あらかじめ一定の期間をかけて所定の試験を行うことを要するので、 本件特許権の存続期間中に、本件発明の技術的範囲に属する医薬品の生産等を行えないとすると、特許権の存続期間が終了した後も、なお相当の期間、本件発明を自由に利用し得ない結果となるが、この結果が特許制度の根幹に反するものであることは、平成11年最判の判示するとおりである。 â‘¢ […]
