Karin Law: how will it affect companies?

The Official Gazette published yesterday, January 15, Law No. 21,643, which modifies the Labor Code and other legal bodies regarding workplace and sexual harassment and incorporates the concept of violence at work , with a focus on its prevention, investigation and sanction, known as “Karin Law”.

With the implementation of the new Law, companies must guarantee a “ work environment free of violence, compatible with the dignity of the person and with a gender perspective . ” Sexual harassment, workplace harassment and violence at work generated by third parties (“ Acts of Violence ”) will be considered contrary to this principle.

Relevant aspects of the new Law

1. In terms of workplace harassment, repetition of the behavior will no longer be relevant. For it to be established, a single act that could undermine, mistreat or humiliate a person or affect their employment situation or employment opportunities will be enough .
