Senior Associate Mustafa Bohra and Associate Nikhilesh Koundinya, have authored a research paper on unlocking the Potential of Early Neutral Evaluation (ENE) in India’s Dispute Resolution landscape. With over 4.47 crore cases pending in the Indian judicial system as of April 27, 2024, the need for efficient dispute resolution mechanisms is critical. Traditional litigation is often time-consuming and costly, leading to exploration of alternative methods such as ENE.
ENE is a voluntary process where a neutral expert assesses the issues and facts of a dispute, providing an unbiased evaluation to help parties understand their case’s strengths and weaknesses. This approach has proven successful in the US and UK, and its adoption in India could potentially reduce court backlogs and enhance timely justice delivery.
The research paper delves into how ENE can transform India’s dispute resolution landscape, aiming to make justice more efficient and accessible.
